A modified NASCAR rule now expands race fields to 41 cars when teams use the Open Exemption Provisional (OEP), ensuring fair competition without displacing other qualified drivers.

Key changes to the OEP rule include:

  • Automatic field expansion to 41 cars when an OEP is granted and more than 40 teams enter
  • Field composition: 36 charter teams, minimum 4 open teams, plus OEP team
  • Teams must apply 90 days before an event
  • Only one OEP granted per race
  • NASCAR maintains discretion over which team receives OEP if multiple teams apply
  • Teams using OEP remain ineligible for points and prize money
  • NASCAR can declare certain events ineligible for OEP use

This update follows feedback from industry stakeholders, including seven-time champion Jimmie Johnson's discussion with NASCAR chairman Jim France about ensuring OEP usage doesn't prevent other teams from competing.

The rule's first implementation occurred at the 2025 Daytona 500, where Trackhouse Racing used it for Helio Castroneves' No. 91 entry. When Castroneves needed the provisional, the field expanded to accommodate all qualified teams plus his entry.

These modifications reflect NASCAR's commitment to maintaining competitive balance while providing opportunities for high-profile drivers to enter select events.
