NASCAR's motion to dismiss the antitrust lawsuit filed by 23XI Racing and Front Row Motorsports has been denied by U.S. District Judge Kenneth Bell.

The lawsuit, filed on October 2, alleges that NASCAR employs anti-competitive practices and that the France family has unlawfully monopolized stock car racing. Judge Bell determined that the plaintiffs have sufficiently alleged plausible antitrust claims that warrant further investigation.

Key developments in the case:

  • Trial date has been set for December 1
  • NASCAR's request for teams to post bond was denied
  • The bond was intended to cover potential prize money reimbursement if NASCAR won the case
  • Judge Bell noted that harm to NASCAR from allowing plaintiffs to race chartered cars is currently "uncertain and unquantified"

The court's ruling doesn't prevent NASCAR from pursuing reimbursement later if they can prove harm from a wrongfully entered injunction. The case will proceed to allow for full discovery of relevant facts and potential trial, unless resolved earlier by the parties or the Court.
